Terms of Service

1. General Information

These Terms of Service ("Terms") govern the sale and use of digital goods offered by Kaiwan Shaban ("we," "us," "our"). By purchasing or downloading any product from our store, you agree to these Terms.

Our business is registered and operating under the laws of Poland and applicable EU regulations.

2. Products

We offer two categories of digital goods:

• Digital Artworks (e.g., Wallpapers)
  
  
• Licensed for personal use only.
  
  
• You may use them on your personal devices (phone, tablet, computer).
  
  
• You may not reproduce, resell, distribute, or use them for any commercial purpose (including advertising, resale, or client work).
  
  
• Creative Tools (e.g., LUTs, Presets, Filters)
  
  
• Licensed for both personal and commercial use.
  
  
• You may use them in your photos, videos, or creative projects, including commercial projects for clients.
  
  
• You may not resell, redistribute, or claim the LUTs/Presets as your own product.
  
  

3. License

When you purchase a product, you are granted a non-exclusive, non-transferable license to use the digital goods according to their category (see Section 2). Ownership of the intellectual property remains with Kaiwan Shaban.

4. Payments and Refunds

• All prices are listed in euros (EUR) and include applicable taxes unless stated otherwise.
  
  
• Due to the nature of digital goods, all sales are final. No refunds or exchanges will be issued once the product has been downloaded.
  
  

5. Intellectual Property

All products, images, and content are protected under copyright law. Unauthorized reproduction, redistribution, or commercial use of digital artworks (wallpapers) is strictly prohibited.

6. Liability

We are not responsible for:

• Technical issues related to device compatibility.
  
  
• Any damages, losses, or claims resulting from misuse of the digital goods.
  
  

7. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Poland and the applicable laws of the European Union. Any disputes shall be resolved under the jurisdiction of Polish courts.

8. Updates to Terms

We may update these Terms at any time. Continued use of the products after changes indicates acceptance of the updated Terms.
